Benromach Champions Competition

By entering the Benromach Champions Competition (the “competition”), you accept and agree to be bound by these terms and conditions:

Terms & Conditions

The competition is run by Speymalt Whisky Distributors Limited (“us”, “we”, “the Promoter”) (Company Number SC037522); our registered office is at George House, Boroughbriggs Road, Elgin, Scotland, IV30 1JY
The competition is open to entrants aged 18 years and older. Evidence of address and proof of age may be required. Any entries persons under the age of 18 (or who cannot verify they meet the age requirement) will not be accepted as valid entries. The Promoter must comply with regional legislation. Where local laws do not permit the inclusion of alcohol as prizes, the winner will not be able to claim the bottle of 15 Year Old, but will still be eligible for the trip to our distillery.
Employees of the Promoter or their families, agents or anyone professionally connected with the competition or the Promoter are prohibited from entering.
Entrants will be asked to submit a link to a short 60 second video telling us what their favourite Benromach dram is and why. To enter, submit the video link and your entry via a form on the Benromach website www.benromach.com
Your entry submission shall not comprise of anything which is obscene or vulgar, offensive, abusive, harmful, threatening, libellous, defamatory, invasive of another’s privacy, sexually or racially or ethically or religiously insulting, harassing, abusive, profane or otherwise unlawful, nor anything which infringes the intellectual property or other rights of any other person. Any entry which we consider to be in breach of this condition may be disqualified from the competition.
The competition opens on 6^th June 2024 and closes at midnight 26^th June 2024. No entries will be accepted after competition closing and the Promoter accepts no responsibility for entries made after this date. Three winners will be selected from the entries received and notified by 28^th June 2024.
Entries are limited to one entry per person. Multiple entries will not be accepted.
No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. Incomplete or corrupted entries or those not in accordance with the entry instructions will be rejected.
The Promoter is not responsible for any entries lost, damaged or delayed as a result of any kind of network, computer hardware or software failure of any kind. The Promoter is not responsible for the actions of entrants in connection with this competition in attempting to either circumvent these terms and conditions or interfere with the administration, security, fairness, integrity or proper conduct of the competition. Any entrant found to be tampering with or abusing the entries to this competition or anyone who we believe to be causing error or malfunction or disruption or damage or anyone we consider to be in breach of these terms and conditions may be disqualified from this competition.
The winners will be chosen by a panel of judges from all valid entries received by the closing date. The judges’ decision is final.
The three winners will be contacted by email by 28^th June 2024. All reasonable effort will be made to contact the winners, however, if the winners have not responded by email by 5^th July 2024 an alternative winner or winners may be chosen from the entrants or as the judges may determine in their sole discretion. The winners must be available to attend a trip to Benromach on the week of 19^th-23^rd August 2024 and the Promoter reserves the right to withdraw the prize/offer an alternative prize for any selected winners that are unavailable on any of those dates.
The judge's decision is final and no correspondence will be entered into.
First prize is a trip to Benromach between 19^th-23^rd August 2024. Return travel and accommodation will be provided for the winners on or around those dates as required, along with a bottle of Benromach 15 years old whisky.
The prize is non-transferable and there is no cash or other alternative to the stated prize. However the Promoter reserves the right to provide an alternative prize of equal or greater value if the advertised prize becomes unavailable for reasons beyond the control of the Promoter.
Throughout the trip to Benromach, each winner shall comply with:
1. all health and safety and other on-site rules and procedures from time-to-time in force at Benromach and communicated to them, and
2. the reasonable instructions of Benromach staff engaged in briefing, supervising or chaperoning winners.
Each winner will agree to the Promoter filming and taking photography of the trip and promoting this material across their marketing platforms and any campaigns directly related to this promotion. Ownership of any and all intellectual property in any such filming and photography shall remain with the Promoter.
By entering the competition, the entrant will be deemed to have agreed that any and all intellectual property in and to the entry they have submitted (the “Works”) belongs exclusively to the Promoter and may be used by us for business and other purposes in our sole discretion. Entrants agree to:
1. assign to the Promoter absolutely any and all of their rights, title and interest in or to the Works; and
2. unconditionally and irrevocably waive in favour of the Promoter and its successors in title any right, title or interest in or to the Works (including but not limited to moral rights, insofar as capable of waiver) to which the finalists become entitled at any time under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
By entering the competition entrants agree that their personal data submitted as part of the competition process will be stored and processed on their behalf by the Promoter as data controller in accordance with applicable data protection laws and in accordance with the Promoter’s privacy policy [https://retail-gordonandmacphail.com/pages/privacy-policy], as applicable
1. Entrants agree that such data:
  1. includes the entrant’s name, address, contact details and biographical data (including any images, audio and video footage of the entrant) submitted in connection with the competition
  2. may be used by us and by our processors for the purposes of business analysis and research for the administration of, and your participation in, this competition
  3. may be used to contact the winner(s) of the competition and that the winner(s) name(s) will be provided to third parties on request.
  4. may be used in marketing and promotional activity in connection with the competition in the legitimate interests of the Promote.
2. A request to access, update or correct any information should be directed to us at [[email protected]].
Winners will be required to take part in publicity relating to the competition and recognise that the processing of their name and image (and any audio and video footage of the entrant) is in the legitimate interests of the Promoter in connection with the delivery of this competition and the prizes.

Neither we nor our employees, agents or representatives accept responsibility for any loss, damage or injury incurred by a winner (or anyone else) as a result of redemption of their prize as far as is permitted by law. Nothing in this condition limits any liability which cannot legally be limited.
This competition and these Terms & Conditions are governed by Scots law and subject to the exclusive jurisdiction of the Scottish Courts.
